If you saw a patient on August 3, 2007 and then just saw the patient again on August 2, 2010, how would you bill the visit?

We know the 3 year rule states that in order to bill an office visit as "new" the patient must not be seen for 3 years. We fall short of meeting this criteria by 1 day. Do you think we can bill the visit as new or should we go with an established patient visit?
