We are having a little bit of debate here in my office about new patient E/M codes. We have a provider who was previously with a different medical group and some of her patients have transferred over to our group to continue to go to her. Since we bill under our group Tax ID but the provider's NPI is attached, can we use new patient codes for their first visit in this office?
CMS website states "same provider or provider group", but does that just make it clear that the providers in the same group cannot use new patient E/M within 3 years?
 
You still have to bill an established patient because the patient is not new to the provider even though the provider is new to your group.
