Np cant be an assistant surgeon

Hi, one of our clients got a new NP. Located in NY. Medicare denying assistant surgeon claims saying NP cant be an assistant for code 27130. Saying its outside scope of practice?

Scope of Practice is the state law.

You would have to figure out if they are allowed to be assistant at surgery in NYS. And/or was the claim correctly coded, modifiers, etc. Is the provider credentialed correctly, etc.
