Wiki Nurse Practitioner and Venipuncture?

Can someone provide guidance ? Office setting. The MA has been unsuccessful in some draws requiring the nurse practitioner to draw blood. The NP wants to charge 36415 for the MAs attempt and 36410 for her successful venipuncture. I know 36410 is incorrect but they want something extra for her time drawing blood.
 
It is not appropriate to bill for the MAs work that was unable to be done if the NP needed to draw.
I do think 36410 is correct for the NPs work in such a situation. I also suggest the record be documented accordingly as you may need to submit records to get 36410 paid that is was not routine.
36410 Venipuncture, age 3 years or older, necessitating the skill of a physician or other qualified health care professional (separate procedure), for diagnostic or therapeutic purposes (not to be used for routine venipuncture)
