I have been approached by a doctor in California who does not participate with any medical insurance plans but files claims as a courtesy to the patient. He has a standard fee schedule that he bills out to the insurance, but collects a fee rate based on services performed. If there is a deductible or co-insurance that is more then the amount he collected he adjusts this off. If the insurance covers everything he refunds the patient. He does note on the claim the amount that is collected from the patient. Is this legal? Is there a article I can quote him?
