Wiki PA as a scribe or not?

A physician see's a patient and has the PA write the chart note where the PA may or may not have been in on the visit and the physician signs the chart note anyways, is this legal?
 
If the PA is not seeing the patient they cannot document for the provider. A scribe's services are very specific. If the PA see's the patient they can only document what they perform, same for the provider. I won't go into incident to rules, since the question is not asking specifically about them.
