Wiki Palliative / CPT 99350 question

Has anyone else ever heard of NP's not being able to bill CPT 99350 in Palliative care? Our state medicaid (WV) says 99350 is not payable to a NP, which seems odd to me since it is a time based code.
 
I would want to see that in writing especially if the provider is billing based on time. But I do remember a time in the way back where Medicaid did not like outpatient providers billing a 99215. That is in the way, way, way back.
