Our office billed a Medicare Advantage Plan that went bankrupt last March. We have filed with Medicare Part B and they to have denied stating there is other insurance on filed. I have appealed this without resolution. Would this be the patient's responsibility or do we need to write this amount off. Thank you for your help, Ann
 
Well, Im not sure why you would bill Medicare if the patient has an Advantage plan as primary. Try billing the Advantage Plan.If they reject for the same issue, bill the patient and tell them they have to straighten the issue out between Medicare and the other insurance.
 
Bankrupt Medicare Advantage Plan

Contact whichever state agency regulates insurance carriers in your state. There should be someone overseeing the bankruptcy process for the carrier and the claims should ultimately be paid by the insurance company which takes over for the bankrupt carrier.

When the carrier went bankrupt, did you receive any sort of information regarding filing a claim in bankruptcy court? I would not bill the patient until you have very clear instructions from the court, Medicare or other agency stating it is ok to do so.

We had this same issue with Universal Health Care when they went out of business early in 2013. Florida Department of Financial Services finally issues a Proof of Claim form we have to submit with a list of all the claims we still have to be reviewed for payment. We have until 06/30/14 to file this. Definitely look into who you need to contact about getting some payment for these claims.
