If a patient does not want Tricare billed and will pay out of pocket, can we do this? Because it is a government funded program does it still follow the same HIPAA rules?

I know under the new HIPAA guidelines this can be done. I know the information we got said that we must follow this rule by 9/23/13. I would assume this can already be done. It says the request must be made in writing and has to say what the insurance company is not to receive.
