Although we can't bill for a consent, isn't it true that we can bill for the time spent with a patient for informing and educating them with regards to the consent?
 
Who is spending the time with the patient?

If your provider is doing counseling regarding a procedure and obtaining a consent form then if they document the time and what they discussed you would use the appropriate E/M code. Or am I misunderstanding your situation?
