Although we can't bill for a consent, isn't it true that we can bill for the time spent with a patient for informing and educating them with regards to the consent?

As long as it's not global to the procedure, yes, you can code using the appropriate E/M level based on time spent in counseling/coordination of care.

Check CPT guidelines to be sure your documentation supports this.
