If an elderly patient has laparscopic cholecystectomy, and is released from the hosptial without incident. The one month post op is returned to the ER from the nursing home with abdominal pain and vomiting. Surgery is asked for a consult. Determines patient has a small bowel obstruction.

Can any visits by the surgeon be billed as subsequent w/24 modifier, or would this still be post op?

I realize and have seen patients who develop obstructions with a few days of surgery, however am not sure about the patient who has an uneventful recovery for a month postop, then develops a problem.

Any help is appreciated.
