Looking for more clarification on E&M and procedures, new or established patients. Have researched and have found conflicting answers.

If a patient is seen for a new problem, Dr assesses and decides to do a procedure. Would the E&M be included in the procedure? What if the patient is new, does this make a differerence?

I am pretty sure you can charge both E&M and the procedure, and just add modifier 25 to show it was separate and significant, and it shouldn't make a difference if they where New or Established.
