I have 17 therapists here and sometimes we refer a client to another therapist here. Many times, a therapist will see an individual for one on one therapy and then will refer them to another therapist for family or marital counseling. We obtain an ROI for each therapist to discuss the client. Now they are thinking that we need an ROI to speak with the other family members or spouse. Is this the case if they are not the actual client? What are we legally required to do?

Hi there, if the discussion will (or might) disclose the patient's PHI you'll definitely want to get the patient's permission first.
