Hoping someone can help me. We have a patient (we are PCP) that we received records from her OB/GYN. Our provider wants to know if it is legal to release those records to the patient from our office. Records include test results and hospital records. No progress notes or consults from other physicians. Thanks!:confused:
 
If those records obtained from the OB/GYN were used by your physicians to make medical decisions on the patient, then they become part of the "designated record set" (HIPAA Privacy Rule 164.501) and therefore could be released to the patient. Or...if your practice has a policy that makes records from another entity part of your legal medical record, then you could release them to the patient. Otherwise, it is best if she can obtain those records from the original provider.
