On smoking cessation we use code 99401( for time)
Say the patient came in for gout and states oh..by the way I would also like to quit smoking. Do you code an office visit along with the 99401 and -25 on the office visit. The guideline state Any E/M service reported on the same day must be distinct, and time spent providing these services may not be used as a basis for the E/M code selection. So do this mean I can use the office visit also as long as it is not based on time?
 
I bill and e/m 99xxx- 25, 99406 I used dx 605.1 and v15.82

99401 is preventative care not smoking cessation. 99406 or 99407 are the codes that should be used for smoking cessation depending on time.
