We are a lactation clinic, providers are Nurse Practitioners and Certified Nurse Midwife and IBCLC's. How will shared/split billing apply to our E&M billing, we typically do incident to billing. Does the new CMS rule also apply to commercial insurance carriers.

The split/shared policy released by Medicare applies to services in the facility setting and critical care services. It isn't the same as the CPT split/shared policy for office visits.
Private payers aren't required to adopt Medicare's rules.
