If a physician is doing rounds and their patient is not in their room due to other tests, for example, but the physician review the chart to determine if care should be continued as is or if changes need to be made can the physician bill a subsequent level 1 without seeing the patient??

No. No face-to-face no E/M. If the physician decides to come back later and see the patient the documentation (assuming he does document something the first time) should be combined and leveled based on both notes. Or in the case of billing based on time you would combine the time of the 2 visits.
