Has CMS waived for a physician to have to be on site for "incident to" doing Telemed? Specifically with the office being located in Georgia.

CMS has stated that a physician can provide distant supervision via audiovideo of an incident to personnel and it will qualify for direct supervIsion for the COVID-19 Public Health Emergency. This was included in the April 6th Interim Final Rule Federal Register.

CMS explained in one of he Office Hours calls that the physician just has to be available to supervise via audio video if needed. So even though the physician is really doing “general supervision”, CMS is considering it still “direct supervision” under the waiver for the PHE for telehealth.
