If my doctor documents time do I have to use it? If I went by MDM the level would be higher but they did document detailed time.

It's your option.
You may bill on time OR medical decision making (for 2021 outpatient E/M).
For other E/M codes (pre 2021 or inpt), you may bill on hx, exam, mdm OR time (if >50% in counseling/coordination of care).
