a person in my office today contacted a place that pays for procedures/ visits for hiv patient. the insurance says this is no longer his policy. I am wondering about HIPPA laws calling to see if this patient is eligible, seems that should be up to patient, not a billing person

You are simply calling to determine eligibility - you obtained this information from the patient at some point - you are trying to obtain information for the purposes of payment (falls under TPO of treatment/payment/operations). No HIPAA violation - this is perfectly acceptable disclosure on the part of both your practice and the insurance carrier.
