Wiki would you consider these visits inclusive or not?

So the physican performs a right colectomy and the patient is discharged 2 days later on the 3rd day the patient returns to the hospital w/nausea and vomiting and has an obstruction. Medicare is the ins would you consider these hospital visits from day 3 to day 10 inclusive in the surgery or billable w/modifier 24.
 
Sounds like a post-op Complication and to me it really shouldnt be inclusive. Maybe Appeal it and also the Note has to really state that it is a Post-op Complication
