Wiki 3 year rule new established

Hi, I'm trying to figure out if I have this 3 year rule correct or not. I have always assumed it was 3 years to be a new patient by date of service. I have a biller in the office telling me I am wrong and that it is by 3 years per calendar year. Which of us is right? Please help!!!!

While not explicitly described how to calculate the 'date', everyone I've encountered calculates it by date of service.

I concur. It's from the last date of service provided to the patient.
