Can a physician owned laboratory bill for 84165 and then a physician within the group interpret the results, issue a report and bill for the professional component of the 84165 using the 26 modifier?

Any help would be appreciated!

Why wouldn't you be able to? The 84165 can be billed for both the technical and professional fees. Our facility in house will bill the technical with the 84165 and also the professional fees - done by the same facility but at a different region with 84165 with 26 & 91 modifier.
Note - You have to bill one of those 84165 charges with the 91 modifier because they both occurred on the same DOS and they both have the same procedure number.
