Wiki 96445 with Medicare patients

I have a situation of surgeon doing the administrion of peritoneal chemotherapy after but in the same session as a colectomy 44140 44139
we billed 96445 and Medicare is lumping this code into an lcd and it must be billed with a J code, but this is an in patient case and we are not billing for the drugs. Has anyone come accross this situation?
Help please and thanks in adbance:confused:
