Can anyone tell me if a Hospital employed Orthopedist who is on-call can bill code 99053 for after hours in the ED?

Our Orthopedist is insisting that he bill this code (which we have never billed) so that he can get the RVU credits for being pulled out of bed at night for a patient in the ED. I have told him that Medicare does not pay for this service and he says he didn't care as long as he got his RVUs. I have researched this and find there are no RUVs for this code since Medicare does not pay, but I am just wondering if this would be an appropriate use for this code since I have seen according to Supercoder that this code is intended for situations in which the physician has to make a special trip in to provide the service and I was not sure if on-call would fall under that definition.

I would appreciate any ideas or supporting documentation on this that anyone may have!
