Wiki Appeal Liability denials with Medicare

We get denials all the time from Medicare when a patient has had a liability case open but the case is now closed. The issue we are having is that the liability cases are usually old and there is no longer documentation from the Liability payer to show when the case closed. We cannot bill Medicare as the secondary payer as the funds have been exhausted and we did not receive money. We have never been able to find or get information from an attorney or the liability company to proof the case is closed.

Does anyone have any advice how to appeal to Medicare? We have sent the documentation from the denied visits to show the visit was not due to a liability case but rather the patient seeing their PCP for follow up of comorbidities.

I just want to make sure we are using every resource available to get Medicare to pay.
