I was wondering if under the new 2021 guidelines if residents are allowed to bill based on time? Also if they are considered clinical staff or a qualified health professional?
 
You cannot now, and could not previously, count a resident's time. The possible exception is for Primary Care Exception Rule, which I have no experience in and are not familiar with the nuances.
You may count only the teaching physician's time. Remember that the 2021 new guidelines only apply to outpatient. For inpatient, the guidelines have not changed and time may only be used if > 50% is spent counseling/coordination of care by the physician.
