Can an attending physician see and bill for his/her own census at the same time the Fellow they are supervising sees and bills for patients? I need a CMS regulation to reference to satisfactorily answer my manager. Thanks!!!

Exact same patient?

Let's see if I understand this correctly.

The fellow is seing Patient X and billing for those services.
Supervising doctor ALSO sees patient X on same DOS (and maybe at same time or right after fellow?) and ALSO wants to bill for his/her services?

No can do. If the fellow needs this close supervision, then I'd say bill for the attending and do not bill for the fellow.
