Billing e/m based on time spent with family member

CPT says face to face time (office setting) is defined as only that time that the physician spends face to face with the patient and/OR FAMILY. POA desires consultation with provider to discuss treatment options, questions, concerns for family member (PATIENT WILL NOT BE PRESENT). POA desires to bring pictures of elderly patient documenting area to treat via Mohs. Inga Ellzey states in order to bill insurance PATIENT MUST BE PRESENT. The fact that CPTsays face-to face can be with family can we then bill based on time since no exam is possible without patient being there?:confused:Thanks

In these situations, we generally tell the family member upfront that we will be billing as a self pay in the family member's name. V65.19 as the primary diagnosis.
