If a resisdent performs the service, the attending puts the appropriate teaching attestation and it supports a level 3, BUT the teaching physician also notes NON TEACHING time spent was 20 minutes - do I bill based on the non teaching time noted and leave off the GC modifier or do I bill based on residents dictation with a GC modifier. Basically I'm asking do I bill based on time or documentation in this scenario?
 
Currently, you may bill on either of hx/exam/mdm OR time (if >50% in counseling/coordinatio of care). You may choose whichever gives you a higher level. Think of it like 1995/1997 guidelines. You get to choose which you want to use. I personally find that almost all the time, documentation gives a higher level than time, but that can vary by specialty and physician.
