Billing for co-pay from Medicare if pt has Medi-cal.

Can a private practice that is not contracted with Medi-cal bill the pt for the Medicare copay when the pt has Medi-cal as a secondary coverage? I believe the practice cannot bill for the Medicare co-pay since the pt has Medi-cal as a secondary coverage. I am looking for something current in writing to support this.
 
Are you talking about medicaid? If so then no you cannot bill the pt. Medicaid will process saying paid because medicare paid the maximum allowed amount.
