Wiki billing for prolonged visit during labor

Scenario: A midwife is seeing a patient multiple times throughout the day during labor (documenting time for each visit) and the patient does NOT deliver that day, can the midwife bill prolonged service codes 99356, 99357 with her initial or subsequent hospital E/M? The patient has not previously been seen in our midwife clinic. The midwife does bill the delivery only code 59409 for the actual date of delivery.
