Billing hospital follow-up visits without an initial consult.

I have a strange situation that my coworkers and I have never encountered before. I work at a private gastroenterology practice. The doctors' do consults at different hospitals in the area. In this case, the doctor did an EGD on a patient in the ER who had food stuck in his throat. He did not know the patient ended up being admitted, and never did an initial consult report. The patient was then seen two more times by our Nurse practioners, and they did write follow up reports.

My question is, are any of these visits billable? Should I bill both visits by the NPs as 99231-99233, or bill the first as 99221-99223? He was technically seen by the doctor first, but he only did an EGD.

If anyone has had a similar situation, or has any insight on this issue, I would greatly appreciate your advice.
