My question is simply this, our has been seeing an increased number of patients in his primary care practice that are using medical marijuana, he does not prescribe it for them but does notate the treatment in their charts; Should we be using ICD 10 code f12.90 cannabis use, uncomplicated on the claims or is this for drug use not prescribed by a practitioner?

billing out a "re-do History and physical visit"

Patient seen outside of the 30 days for an upcoming surgery scheduled. reviewed original history and physical and updated accordingly. Can this be a billable encounter?

You should not be using the code unless the provider documents that this use is associated with a problem that is being evaluated or treated at the encounter. See the note from the Chapter 5 section from the ICD-10 official guidelines:

As with all other unspecified diagnoses, the codes for unspecified psychoactive substance use (F10.9-, F11.9-, F12.9-, F13.9-, F14.9-, F15.9-, F16.9-, F18.9-, F19.9-) should only be assigned based on provider documentation and when they meet the definition of a reportable diagnosis (see Section III, Reporting Additional Diagnoses). These codes are to be used only when the psychoactive substance use is associated with a physical, mental or behavioral disorder, and such a relationship is documented by the provider.
