Can a Therapist bill with 90832 and an NP bill with an E & M code on the same day w/o a modifier?

Providing services at the same SNF:

  1. NP provider is scheduled for a SNF on a particular day of the week.
  2. Talk Therapy provider {LCSW, PsyD or PhD} scheduled for a different day of the week.
  3. We have been informed they cannot see patients on the same day as it will cause a billing issue.
Can I code this without a modifier 25? Modifier 25 is just for E & M codes, correct?
 
25 modifier indicates Significant, Separately Identifiable Evaluation and Management Service by the Same Physician or Other Qualified Health Care Professional on the Same Day of the Procedure or Other Service.

Your situation patient seen by different provider with different session so i dont think 25 modifier is applicable.
