Is this correct?

If a physician spends more than 50 percent of a face-to-face visit counseling or coordinating a patient's care, the physician can code the visit on the basis of time, even if the history, exam or medical decision making elements are lacking.

This is correct but there are certain criteria that must be met.

True, part of which is that ALL the time must be face-to-face, and MORE than half the total time must be spent in counseling/coordination of care. Documentation must list total time, amount of total time spent in counseling and nature of the counseling.

But if the counseling is less than 50 %, could we bill the E/M visit plus the 99401-99409 category?
