I bill for DME and the diagnosis is TBI I used S06.9X9S as it is an old injury. Can I use this as my primary diagnosis
 
Sure? Without knowing what code within DME, it's hard to say specifically what is allowed. But that's a billable-specific code according to ICD10 Data.

I would probably specify any residual deficits or ongoing symptoms that your equipment is hopefully going to treat, as TBI isn't the sort of diagnosis you can just stick a cast on.
 
coding guidelines tell you to code the sequela condition first followed by the injury code:

"The 7th character “S” identifies the injury responsible for the sequela. The specific type of sequela (e.g. scar) is sequenced first, followed by the injury code."

S0 to answer your question then no you cannot use the injury code with the 7th character S as the first listed code.
