Only the admitting physician can charge a discharge. However, what if that provider does not submit a formal H&P because it was done in the office? Can you charge 99238/99239 a discharge code if there is no H&P or initial code from the same speciality? For example, the patient was seen in the office and a procedure is decided. A week later the patient is admitted for that procedure and no H&P is billed because of the office visit. The patient is discharge. Can that discharge be billed without a 99221-99223?
