Doctor wants to bill 99213 for Rx refills without seeing the PT face to face

I don't think this is legal or moral - am I wrong? If I am what code would be the best to use?
 
No you cannot use a 99213 for a prescription refill when there is no patient encounter. I am curious though as to if this was a patient calling the provider to request this be done. If so then you can bill that as a phone call 99441-99443 providing the patient is the one that called the provider and it was a minimum of 5 minutes as well as the other parameters outlined for the use of these codes in the CPT book.
 
Umm... not even close! 99213 has time criteria for counseling OR it has History, Exam and/or MDM requirements to be met.
