Wiki Dr's moved to new Practice w/ their Established patients, New Pt. E/M?

We have two Physician's who left a Hospital Based Practice and joined our New Practice. A majority of their patients, from their previous practice are following them to our New Practice. Based on this, would we code a New Pt. E/M visit in lieu of an established Pt. visit? The documentation does not reflect a new visit, as they are stating that the patient is here for a follow up.
 
Regardless of what the documentation stated, these are established patients.
A new patient "has not received any professional services, Evaluation and Management (E/M) service or other face-to-face service (e.g., surgical procedure) from the same physician or physician group practice (same physician specialty and subspecialty) within the previous 3 years."
