One statement isn't really enough to definitively say what level it should be - other factors in the visit note would matter too.

Have you tried using the interactive E/M leveling tool on the AAPC website? I use this at least a few times a week when I have a question about what level to assign.

The problem and the risk of treatment are 2 different categories, and I think you are intermingling them.
