Wiki E/M & Surgical Procedure Different Providers/Same Tax ID - Billing?

We had patient scheduled for a follow-up visit whom saw one provider within our practice to discuss medications, pain etc.

Patient had lumbar epidural steroid shots in the past with success. During the visit it was determined that the patient would be scheduled for another 62311.

Another provider within our practice, under the same tax ID/specialty had an open slot the same day to do the 62311. Rather than schedule the patient another day, the patient had a 99214and 62311 the same day.

Patient's insurance is Medicare.

Can both the 62311 and 99214 be billed the same day from different providers under the same tax ID/specialty?

If this scenario had been the same provider for both the e/m and surgical procedure, we may use a modifier -25, the description of the modifier 25 states "same physician". In this scenario, they are not the "same physician" although they are under the same tax ID/speciality, maybe that would be considered "same physician."

Any insight is appreciated.

According to the Medicare Claims Processing Manual 100-04, Chapter 12, Section 30.6.5, "Physicians in the same group practice who are in the same specialty must bill and be paid as though they were a single physician."

So in your scenario, they would be considered the same physician and if the documentation supports the 25 modifier you could use it on the E/M.
