E/R visits with psych

There has been some conflicting answers to this. If a patient is brought to the ER and psych is called in to do an assessment. Can the psych provider bill 90792 with the ER provider putting in their ER E&M? We were told that everything other than the ER provider was a consult.
 
1. Consultations require an order, are there orders for "everyone else is a consult?"
2. The Psych provider should bill the code that best reflects the service they are performing. Is there an order for a consult and that consult is requesting an opinion, or is psych called for the psych eval? "Evaluate and treat" is not a consultation, it's a request for the psych provider to take over that portion of the care.
3. Providers other than ER docs can bill ER codes.
