EGD after sedation but did not pass UES

Patient was scheduled to have EGD and Colonoscopy. When patient arrived, she informed us she refused to prep for colonoscopy so the provider decided to "cancel" it. Patient was sedated and EGD was attempted but patient became combative and would not allow scope passage through UES.

Would this just be 43235 with modifier 53? I wonder because the scope did not technically pass into esophagus at all, although she had been sedated. I have been advised to bill an E/M visit but I feel since she was sedated the procedure was started and needs to be billed.

The physician does not plan on repeating the procedure unless symptoms persist and he will do it under general anesthesia.

Any advice is appreciated.
