A patient that was seen in the ED on 10-18 with abdominal pain and was transferred to inpt observation at 1:11 pm. The patient was then released on 10-19 at 10am which makes them in observation for about 21 hours. The patient came back on 10-20 for the same reason of abdominal pain. Since this was a completely different day, can we bill for a separate E/M or since this was the same reason for them coming back would this be considered a global visit in a sense?

Evaluation and management codes do not have global periods. You just cannot report 2 for the same DOS. Same problem on a different DOS is reportable.
