If our nursing staff documents 120 minutes of critical care time, but our physician only documents 35 minutes of critical care time, can we bill facility charges 99291 x 1, 99292 x 2, even though the physician is limited to 99291 x 1?

Facility charges are generally based on resource utilization rather than documentation of professional services performed. Each facility is supposed to set up their own internal guidelines for charging, so I'd recommend you direct this question to your supervisor or manager. There aren't general coding guidelines for facility charging the way there are for physician services.
