BWC of Ohio is requesting money back for E/M claims that was performed by another physician during global period. I really don't think 24 is good to use???

If your provider is not doing post-operative care, a modifier 24 is not appropriate nor should it be required and you should appeal that denial. The global period only applies to the provider who performed the surgery, or covering providers who are providing post-operative care.

If the E/M's are for a different issue (from the procedure) add modifier 79. You may have to send the medical records with an appeal for this also.

Mod 79 is not for E/M. If the E/M is for a problem unrelated to the surgery, but by a different physician in the same group as the surgeon, the payer will consider it bundled into the global period, unless modifier 24 is used. If the E/M is by a provider that is not in the same group specialty as the surgeon, the payer should not consider this bundled, and no modifier should be necessary.
