hospital billing confusion

I have a patient that we admitted for observation on 5/17 but we didn't actually see patient until 5/18 and then is discharged on 5/18. Would this be billed as 99234/35 or would you need to use new/established codes?
 
If this is Pro Fee and the physician did not see the patient until 5/18 then you cannot bill for the 17th. You would only be able to bill the discharge on the 18th with 99217.

For professional, the physician has to actually see the patient. So, in this case, we need more information as to whether or not the patient was seen face to face on 5/17 or 5/18.
 
So the patient presented to the ER and was admitted under Urology on 5/17as observation. We saw patient on 5/18 and did a stone procedure same day. Provider did a H&P. Is this coded as new/established?
