If the dr saw a patient in the hospital, can we charge a new patient visit 99204 when the patient comes into the office?
 
It depends. When was the inpatient service performed? Was a procedure performed? If so, is the OV part of the global package?

If the patient received professional services (face-to-face services rendered by a physician and reported by a specific CPT code) from the physician within the past three years, the patient is established.

If no professional services were performed within the past three years, new patient office codes 99201-99205 are assigned with supporting documentation.
 
It was an 99222 Initial hospital care. Then he came into the office for a visit about a week later.
